劳动合同
除劳动法第二十五条规定的情形外,劳动者在医疗期、孕期、产期和哺乳期内,劳动合同期限届满时,用人单位不得终止劳动合同。劳动合同的期限应自动延续至医疗期、孕期、产期和哺乳期期满为止。
Opinionson the implementation of the Labor Law of the People's Republic of China,Article 34
Except for the circumstancesspecified in Article 25 of the labor law, the employer shall not terminate thelabor contract when the term of the labor contract expires during the medicaltreatment period, pregnancy period, maternity period and lactation period. Theterm of the labor contract shall be automatically extended to the expiration ofthe medical treatment period, pregnancy period, maternity period and lactationperiod.
