环境监测管理办法（2007年9月1日）第二十一条

排污者必须按照县级以上环境保护部门的要求和国家环境监测技术规范，开展排污状况自我监测。排污者按照国家环境监测技术规范，并经县级以上环境保护部门所属环境监测机构检查符合国家规定的能力要求和技术条件的，其监测数据作为核定污染物排放种类、数量的依据。不具备环境监测能力的排污者，应当委托环境保护部门所属环境监测机构或者经省级环境保护部门认定的环境监测机构进行监测；接受委托的环境监测机构所从事的监测活动，所需经费由委托方承担，收费标准按照国家有关规定执行。经省级环境保护部门认定的环境监测机构，是指非环境保护部门所属的、从事环境监测业务的机构，可以自愿向所在地省级环境保护部门申请证明其具备相适应的环境监测业务能力认定，经认定合格者，即为经省级环境保护部门认定的环境监测机构。经省级环境保护部门认定的环境监测机构应当接受所在地环境保护部门所属环境监测机构的监督检查。

Measures for the management ofenvironmental monitoring (Septermber 1, 2007) Article 21

Polluters must carry out self-monitoring of their pollutiondischarge in accordance with the requirements of environmental protectiondepartments at or above the county level and the state technical standards forenvironmental monitoring. If a polluter complies with the national technical standards forenvironmental monitoring and is inspected by the environmental monitoringinstitution affiliated to the environmental protection department at or abovethe county level to meet the capacity requirements and technical conditionsstipulated by the state, its monitoring data shall be used as the basis fordetermining the types and quantities of pollutants discharged.Those who do nothave the capability of environmental monitoring for discharging pollutantsshall entrust the environmental monitoring organs belonging to theenvironmental protection departments or the environmental monitoring organsrecognized by the environmental protection departments at the provincial levelto carry out monitoring. The expenses needed for the monitoring activities undertaken bythe entrusted environmental monitoring agency shall be borne by the entrustingparty, and the fee standard shall be implemented in accordance with therelevant provisions of the state. The environmental monitoring agency inenvironmental protection departments at the provincial level, refers to thesubordinate to the environmental protection department, engaged in theenvironmental monitoring institution, may voluntarily apply to the localenvironmental protection departments at the provincial level to prove itsability that have adapted to the environmental monitoring business, identifiedas eligible, namely for the environmental monitoring agency in environmentalprotection departments at the provincial level. An environmental monitoring institutionaccredited by an environmental protection department at the provincial levelshall accept the supervision and inspection of an environmental monitoringinstitution subordinate to the local environmental protection department.
