排污许可管理条例 第二条（2021年3月1日）

依照法律规定实行排污许可管理的企业事业单位和其他生产经营者（以下称排污单位），应当依照本条例规定申请取得排污许可证；未取得排污许可证的，不得排放污染物。

根据污染物产生量、排放量、对环境的影响程度等因素，对排污单位实行排污许可分类管理：

（一）污染物产生量、排放量或者对环境的影响程度较大的排污单位，实行排污许可重点管理；

（二）污染物产生量、排放量和对环境的影响程度都较小的排污单位，实行排污许可简化管理。

实行排污许可管理的排污单位范围、实施步骤和管理类别名录，由国务院生态环境主管部门拟订并报国务院批准后公布实施。制定实行排污许可管理的排污单位范围、实施步骤和管理类别名录，应当征求有关部门、行业协会、企业事业单位和社会公众等方面的意见。

The regulation onmanagement of pollutant discharge permits (2021),Article 2

Enterprises, institutions, other producers andbusiness operators that are subject to the administration of pollutantdischarge permits according to law (hereinafter referred to as pollutantdischarge units) shall apply for a pollutant discharge permit in accordancewith the provisions of this Regulation; Discharging units that have notobtained discharge permits must not discharge pollutants.

China implements a classified management of pollutantdischarge permits for pollutant discharge units based on factors such asproduced amount of pollutants, discharge amount and extent of environmentalhazards:

1)    For discharging units with relatively large amount ofproduced and discharged pollutants or with relatively high degree of environmentalhazard, a focused management of discharge permit applies;

2)    For discharging units with relatively small amount ofproduced and discharged pollutants or with relatively low degree ofenvironmental hazard, a simplified management applies; 

A list of the scope, implementation steps andmanagement categories of pollutant discharge units subject to theadministration of pollutant discharge permits shall be drawn up by thecompetent department of ecological environment under the State Council andpublished for implementation after being submitted to the Council for approval. When formulating a list of the scope, implementationsteps and management categories of pollutant discharge units subject topollutant discharge licensing administration, opinions shall be solicited fromrelevant departments, trade associations, enterprises, institutions and thegeneral public.
