食品经营许可和备案管理办法（自2023年12月1日起施行）

第二条  食品经营许可的申请、受理、审查、决定，仅销售预包装食品（含保健食品、特殊医学用途配方食品、婴幼儿配方乳粉以及其他婴幼儿配方食品等特殊食品，下同）的备案，以及相关监督检查工作，适用本办法。

第四条  在中华人民共和国境内从事食品销售和餐饮服务活动，应当依法取得食品经营许可。

下列情形不需要取得食品经营许可：

（一）销售食用农产品；

（二）仅销售预包装食品；

（三）医疗机构、药品零售企业销售特殊医学用途配方食品中的特定全营养配方食品；

（四）已经取得食品生产许可的食品生产者，在其生产加工场所或者通过网络销售其生产的食品；

（五）法律、法规规定的其他不需要取得食品经营许可的情形。

除上述情形外，还开展其他食品经营项目的，应当依法取得食品经营许可。

第二十三条   食品经营许可证发证日期为许可决定作出的日期，有效期为五年。

Measures for the Management of Food Business Licensing and Filing (effective from December 1, 2023)

Article 2 These Measures shall apply to the application, acceptance, review, and decision of food business licenses, as well as the filing of sales of prepackaged foods (including health foods, formula foods for special medical purposes, infant formula milk powder, and other special foods such as infant formula foods, the same below), as well as relevant supervision and inspection work.

Article 4 To engage in food sales and catering service activities within the territory of the People's Republic of China, a food business license shall be obtained according to law.

The following circumstances do not require a food business license:

(1) Selling edible agricultural products;

(2) Only sell prepackaged food;

(3) Medical institutions and pharmaceutical retail enterprises sell specific full-nutrition formula foods in formula foods for special medical purposes;

(4) Food producers who have obtained a food production license sell the food they produce at their production and processing sites or through the Internet;

(5) Other circumstances stipulated by laws and regulations that do not require a food business license.

In addition to the above-mentioned circumstances, if other food business items are also carried out, a food business license shall be obtained in accordance with the law.

Article 23 The date of issuance of the food business license is the date when the decision on the license is made, and the validity period is five years.
