食品经营许可和备案管理办法（自2023年12月1日起施行）第十五条

第十五条  学校、托幼机构、养老机构、建筑工地等集中用餐单位的食堂应当依法取得食品经营许可，落实食品安全主体责任。

承包经营集中用餐单位食堂的，应当取得与承包内容相适应的食品经营许可，具有与所承包的食堂相适应的食品安全管理制度和能力，按照规定配备食品安全管理人员，并对食堂的食品安全负责。集中用餐单位应当落实食品安全管理责任，按照规定配备食品安全管理人员，对承包方的食品经营活动进行监督管理，督促承包方落实食品安全管理制度。

Measures for the Management of Food Business Licensing and Filing (effective from December 1, 2023), Article 15

Article 15 The canteens of centralized dining organizations such as schools, childcare institutions, elderly care institutions, and construction sites shall obtain food business licenses in accordance with the law and implement the main responsibility for food safety.

Whoever contracts to operate the canteen of a centralized dining organizations shall obtain a food business license suitable for the contracted content, have a food safety management system and ability suitable for the contracted canteen, and be equipped with food safety management personnel in accordance with regulations, and shall be responsible for the food safety of the canteen. Centralized dining organizations should implement food safety management responsibilities, deploy food safety management personnel in accordance with regulations, supervise and manage the food business activities of contractors, and supervise contractors to implement food safety management systems.
