食品经营许可和备案管理办法（自2023年12月1日起施行）第三十二条

第三十二条  食品经营者需要延续依法取得的食品经营许可有效期的，应当在该食品经营许可有效期届满前九十个工作日至十五个工作日期间，向原发证的市场监督管理部门提出申请。

在食品经营许可有效期届满前十五个工作日内提出延续许可申请的，原食品经营许可有效期届满后，食品经营者应当暂停食品经营活动，原发证的市场监督管理部门作出准予延续的决定后，方可继续开展食品经营活动。

Measures for the Management of Food Business Licensing and Filing (effective from December 1, 2023), Article 32

Article 32 If a food business operator needs to extend the validity period of a food business license obtained in accordance with the law, it shall submit an application to the original market supervision and management department that issued the license between 90 and 15 working days before the expiration of the food business license.

If the application for renewal of the license is submitted within 15 working days before the expiry of the food business license, the food business operator shall suspend the food business activities after the original food business license expires, and the food business activities shall not be continued until the original market supervision and management department that issued the license makes a decision to approve the extension.
