职业学校学生实习管理规定 第十六条
职业学校和实习单位要依法保障实习学生的基本权利,并不得有以下情形:
(一)安排、接收一年级在校学生进行岗位实习;
(二)安排、接收未满16周岁的学生进行岗位实习;
(三)安排未成年学生从事《未成年工特殊保护规定》中禁忌从事的劳动;
(四)安排实习的女学生从事《女职工劳动保护特别规定》中禁忌从事的劳动;
(五)安排学生到酒吧、夜总会、歌厅、洗浴中心、电子游戏厅、网吧等营业性娱乐场所实习;
(六)通过中介机构或有偿代理组织、安排和管理学生实习工作。
(七)安排学生从事III级强度及以上体力劳动或其他有害身心健康的实习。
Administrative Provisions on Internship of Students from Vocational School, Article 16
The vocational school and the enterprise for internship shall protect the basic rights of interns according to law, and shall not engage in the following circumstances:
(1) Arrange or accept students of Grade One for post-internship;
(2) Arrange students or accept students under the age of 16 to for post-internship;
(3) Arrange juvenile students engage in works prohibited in the Regulation on Special Protection for Juvenile Employees;
(4) Arrange female students engage in works prohibited in the Special Regulation on Labour Protection for Female Employees;
(5) Arrange students to any bars, night clubs, karaoke bars, bath center, electronic game rooms, internet cafes or other commercial entertainment places for internship;
(6) Organize, arrange or manage interns through intermediary or paid agency.
(7) Arrange students to engage in physical labor of Level III intensity or above, or other internships that are harmful to physical and mental health.
