中华人民共和国海洋环境保护法（2023年10月24日 第二次修订）第六十二条

工程建设项目应当按照国家有关建设项目环境影响评价的规定进行环境影响评价。未依法进行并通过环境影响评价的建设项目，不得开工建设。

环境保护设施应当与主体工程同时设计、同时施工、同时投产使用。环境保护设施应当符合经批准的环境影响评价报告书（表）的要求。建设单位应当依照有关法律法规的规定，对环境保护设施进行验收，编制验收报告，并向社会公开。环境保护设施未经验收或者经验收不合格的，建设项目不得投入生产或者使用。

Construction projects shall undergo environmental impact assessment (EIA) in accordance with the State’s regulations on EIA for construction projects. Aproject that has not been lawfully assessed and approved shall not be allowedto start construction.

Environmental-protection facilities must be designed, built and put intooperation simultaneously with the principal works. These facilities shallconform to the requirements set out in the approved EIA report (or EIA form).The construction unit shall, in accordance with applicable laws andregulations, complete acceptance checks of the environmental-protectionfacilities, prepare an acceptance report and make it public. No constructionproject may be put into production or use if the environmental-protectionfacilities have not been accepted, or if they fail the acceptance inspection.
