中华人民共和国危险化学品安全法（2026年5月1日施行） 第四十七条、第四十八条、第四十九条、第五十一条

第四十七条　

使用危险化学品的单位的使用条件（包括工艺）应当符合法律、行政法规的规定和国家标准、行业标准的要求，并根据所使用的危险化学品的种类、危险特性以及使用量和使用方式，建立健全使用危险化学品的安全管理规章制度和安全操作规程，保证危险化学品的安全使用。

第四十八条　

使用国家规定种类的危险化学品从事生产并且使用量达到规定数量的化工企业（属于危险化学品生产企业的除外，下同），应当依照本法的规定取得危险化学品安全使用许可证。

第四十九条　

申请危险化学品安全使用许可证的化工企业，除应当符合本法第四十七条的规定外，还应当具备下列条件：

（一）有与所使用的危险化学品相适应的专业技术人员，从业人员经考核合格；

（二）有安全生产管理机构和专职安全生产管理人员；

（三）有符合国家规定的危险化学品事故应急预案和必要的应急救援器材、装备、设备和物资；

（四）依法进行了安全评价；

（五）法律、法规规定的其他条件。

第五十一条　

使用危险化学品的单位应当将其作业场所使用的化学品安全技术说明书和化学品安全标签提供给从业人员，并加强培训教育，告知从业人员正确使用的方法和在紧急情况下应当采取的措施。

使用危险化学品的个人，应当了解危险化学品的危险特性、正确使用方法和防护措施，不得违法使用、储存、处置危险化学品。

Article47

Theusage conditions (including technological processes) of entities that usehazardous chemicals shall comply with the provisions of laws, administrativeregulations, as well as national and industry standards. Based on the types,hazardous characteristics, usage quantities, and usage methods of the hazardouschemicals used, sound safety management regulations and safety operationprocedures shall be established for the use of hazardous chemicals to ensure safeusage.

Article 48 

Chemicalenterprises that use hazardous chemicals of the types prescribed by the statein their production processes amount to the specified quantity (except for ahazardous chemical production enterprise, here and below) shall obtain a safeuse permit for the hazardous chemicals in accordance with the provisions ofthis Law.

Article 49

Toapply for a safe use permit for the hazardous chemicals, the chemicalenterprise shall meet the following conditions in addition to the provisions ofArticle 47 of this Law:

1) Ithas professional technical personnel commensurate with the hazardous chemicalsused, and the employees have passed the assessment.

2) Ithas a work safety management institution and full-time work safety managementpersonnel.

3) Ithas emergency response plans for hazardous chemical incidents that comply with nationalregulations, as well as necessary emergency rescue apparatus, equipment, facilitiesand materials.

4) Asafety assessment has been conducted in accordance with the law.

5)Other conditions prescribed by laws and regulations.

Article 51 

Anentity using hazardous chemicals shall provide the chemical safety data sheetsand chemical safety labels used in its workplaces to the employees, and strengthentraining and education to inform them of the correct usage methods and themeasures to be taken in emergency situations.

Theindividuals who use hazardous chemicals shall understand the hazard characteristicsof the chemicals, the correct usage methods, and protective measures, and shallnot illegally use, store, or dispose of hazardous chemicals.
