中华人民共和国危险化学品安全法（2026年5月1日施行） 第九十一条、第九十四条

第九十一条　

危险化学品单位应当做好应急准备工作，健全应急管理制度，制定本单位危险化学品事故应急预案，依法建立专职或者兼职应急救援队伍，配备必要的应急救援器材、装备、设备和物资，并定期组织应急救援演练，提高从业人员的应急处置能力。生产经营规模较小的，可以不建立应急救援队伍，但应当指定兼职的应急救援人员，并可以与邻近的应急救援队伍签订应急救援协议。

危险化学品单位应当将其危险化学品事故应急预案按照国家有关规定报送县级以上人民政府应急管理部门备案，并依法向社会公布。

第九十四条　

危险化学品单位发生直接危及人身安全的紧急情况时，在确保安全的前提下，作业现场带班人员、班组长、调度人员有权立即下达停产撤人命令，指挥有关遇险人员撤离。

Article 91

An entityengaging in hazardous chemicals shall make good preparations for emergencyresponse, improve emergency response management system, formulate emergencyresponse plans for hazardous chemical incidents of its own, establish full-timeor part-time emergency rescue teams in accordance with the law, be equippedwith necessary emergency rescue apparatus, equipment, facilities and materials,and organize emergency rescue drills on a periodical basis to enhance emergencyresponse capabilities of its employees. For the entity with a relatively smallerscale of production and operation, it is not required to establish an emergencyrescue team, but it shall designate part-time emergency rescue personnel andmay sign an emergency rescue agreement with the neighboring emergency rescueteam.

Anentity engaging in hazardous chemicals shall, in accordance with relevant nationalreguations, submit its plans for emergency response to hazardous chemicalincidents to the emergency management department of the local government at orabove the county level for recordation, and release them to the public inaccordance with the law.

Article 94

Whenan entity engages in hazardous chemicals encounters an emergency situation thatdirectly endangers personal safety, and under the premise of ensuring safety,the on-site personnel in charge of the shift, team leaders, and dispatchershave the right to immediately issue a production suspension and evacuationorder, and direct the endangered personnel to evacuate.
