使用有毒物品作业场所劳动保护条例（2024年12月6日修订，2025年1月20日施行） 第十一条

用人单位的设立，应当符合有关法律、行政法规规定的设立条件，并依法办理有关手续，取得营业执照。

用人单位的使用有毒物品作业场所，除应当符合职业病防治法规定的职业卫生要求外，还必须符合下列要求：

（一）作业场所与生活场所分开，作业场所不得住人；

（二）有害作业与无害作业分开，高毒作业场所与其他作业场所隔离；

（三）设置有效的通风装置；可能突然泄漏大量有毒物品或者易造成急性中毒的作业场所，设置自动报警装置和事故通风设施；

（四）高毒作业场所设置应急撤离通道和必要的泄险区。

Regulations on Labor Protectionin Workplaces Where Toxic Substances Are Used (Revision on December 6, 2024;effective Januray 20, 2025)

Article 11

The establishment of an employing unit shallmeet the conditions provided for in the relevant laws and administrativeregulations, and relevant formalities shall be gone throughaccording to law and obtain a business license.

The employing unit's workplaces where toxicsubstances are used shall, in addition to meetingthe occupational healthrequirements provided for in the Law on the Prevention and Control ofOccupational Diseases, also meet the following requirements:

(1) the workplaces must be separated from theliving areas, and no person shall reside in the workplaces;

(2) the harmful operations must be separatedfrom the harmless operations, and the workplaces where highly toxicsubstances are used shall be isolated from other workplaces;

(3) effective ventilation installations shall be set up; workplaces,where there is a sudden leakage of large amount of toxic substance or whereacute poisoning may occur, shall be equipped with automatic alarm devices and accidentventilation facilities;

(4) emergency evacuation channels and necessary hazard-relief areas shall be set up in the workplaceswhere highly toxic substances are used.
