使用有毒物品作业场所劳动保护条例（2024年12月6日修订，2025年1月20日施行） 第十三条

新建、扩建、改建的建设项目和技术改造、技术引进项目（以下统称建设项目），可能产生职业中毒危害的，应当依照职业病防治法的规定进行职业中毒危害预评价；可能产生职业中毒危害的建设项目的职业中毒危害防护设施应当与主体工程同时设计，同时施工，同时投入生产和使用；建设项目竣工验收前，应当进行职业中毒危害控制效果评价；建设项目的职业中毒危害防护设施经依法组织验收合格后，方可投入生产和使用。

可能产生职业中毒危害的建设项目的职业中毒危害防护设施设计应当符合国家职业卫生标准和卫生要求。

Regulations on Labor Protectionin Workplaces Where Toxic Substances Are Used (Revision on December 6, 2024;effective Januray 20, 2025)

Article 13

New, expansion, renovationconstruction projects, as well as technological transformation andtechnology-introduction projects (hereinafter collectively referred to as"construction projects"), if they may cause occupational poisoninghazards, shall be subject to a pre-assessment of the occupational poisoninghazards in accordance with the provisions of the Law on the Prevention andControl of Occupational Diseases. The protective facilities againstoccupational poisoning hazards of construction projects that may causeoccupational poisoning hazards shall be designed, constructed, and put intoproduction and use simultaneously with the principal part of the projectengineering. Before the completion and acceptance inspection of theconstruction project, a control effect evaluation of occupational poisoninghazards shall be conducted. After the protective facilities againstoccupational poisoning hazards of the construction project have been legallyorganized for acceptance inspection and qualified, they may be put intoproduction and use.

The design of protectivefacilities against occupational poisoning hazards of the construction projectthat may cause occupational poisoning hazards shall comply with nationaloccupational health standards and hygiene requirements.
