使用有毒物品作业场所劳动保护条例（2024年12月6日修订，2025年1月20日施行） 第十四条

用人单位应当按照国务院卫生行政部门的规定，向卫生行政部门及时、如实申报存在职业中毒危害项目。

从事使用高毒物品作业的用人单位，在申报使用高毒物品作业项目时，应当向卫生行政部门提交下列有关资料：

（一）职业中毒危害控制效果评价报告；

（二）职业卫生管理制度和操作规程等材料；

（三）职业中毒事故应急救援预案。

从事使用高毒物品作业的用人单位变更所使用的高毒物品品种的，应当依照前款规定向原受理申报的卫生行政部门重新申报。

Regulations on Labor Protectionin Workplaces Where Toxic Substances Are Used (Revision on December 6, 2024;effective Januray 20, 2025)

Article 14

The employingunits shall, in accordance with the provisions of the administrative departmentfor public health under the State Council, promptly and truthfully declare the projectswhich involve occupational poisoning hazards to the administrative departmentfor public health.

An employingunit that engages in the operations in which highly toxic substances are usedshall, when declaring projects involving such substances, submit the following relevantmaterials to the administrative department for public health:

(1) theevaluation report on the control effect against occupational poisoning hazards;

(2) materials suchas occupational health management system and operating procedures;

(3) emergency rescureplans for occupational poisoning accidents.

An employingunit that engages in the operations in which highly toxic substances are usedshall, when it changes the varieties of such substances, make anew declarationsto the administrative department for public health that originally accepted itsdeclarations, in accordance with the provisions of the preceding paragraph.
