使用有毒物品作业场所劳动保护条例（2024年12月6日修订，2025年1月20日施行）

第三十一条　

用人单位应当组织从事使用有毒物品作业的劳动者进行上岗前职业健康检查。

用人单位不得安排未经上岗前职业健康检查的劳动者从事使用有毒物品的作业，不得安排有职业禁忌的劳动者从事其所禁忌的作业。

第三十二条　

用人单位应当对从事使用有毒物品作业的劳动者进行定期职业健康检查。

用人单位发现有职业禁忌或者有与所从事职业相关的健康损害的劳动者，应当将其及时调离原工作岗位，并妥善安置。

用人单位对需要复查和医学观察的劳动者，应当按照体检机构的要求安排其复查和医学观察。

第三十五条　

劳动者职业健康检查和医学观察的费用，由用人单位承担。

第三十六条　

用人单位应当建立职业健康监护档案。

职业健康监护档案应当包括下列内容：

（一）劳动者的职业史和职业中毒危害接触史；

（二）相应作业场所职业中毒危害因素监测结果；

（三）职业健康检查结果及处理情况；

（四）职业病诊疗等劳动者健康资料。

Article 31

The employingunits shall organize workers who are going to engage in operations involvingtoxic substances to undergo pre-job occupational health examinations.

The employingunits shall neither assign the workers who have not undergone pre-joboccupational health examinations to toxic substance operations, nor assignworkers with occupational contraindication to the operation they arecontraindicated for.

Article 32

The employingunits shall organize workers engaged in toxic substance operations to undergo regularoccupational health examinations.

If the employingunit discovers workers with occupational contraindications or or those with healthimpairments related to the operations they are engaged in, the employing unitshall promptly transfer them from their original posts, and provide appropriateresettlement.

With respect tothe workers requiring re-examination and medical observations, the employingunits shall arrange re-examinations and medical observations for them asrequired by the examination institutions.

Article 35

The expenses foroccupational health examinations and medical observations for the workers shallbe borne by the employing unit.

Article 36

The employingunits shall establish occupational health surveillance archives.

The occupationalhealth surveillance archives shall include the following contents:

(1) the occupationalhistory and the exposure history of occupational poisoning hazards of theworkers;

(2) the monitoringresults of occupational poisoning hazard factors in corresponding workplaces;

(3) the occupationalhealth examination results and the handling situations;

(4) the health recordsof workers related to diagnosis and treatment of occupational diseases.
