使用有毒物品作业场所劳动保护条例（2024年12月6日修订，2025年1月20日施行） 第三十八条

劳动者享有下列职业卫生保护权利：

（一）获得职业卫生教育、培训；

（二）获得职业健康检查、职业病诊疗、康复等职业病防治服务；

（三）了解工作场所产生或者可能产生的职业中毒危害因素、危害后果和应当采取的职业中毒危害防护措施；

（四）要求用人单位提供符合防治职业病要求的职业中毒危害防护设施和个人使用的职业中毒危害防护用品，改善工作条件；

（五）对违反职业病防治法律、法规，危及生命、健康的行为提出批评、检举和控告；

（六）拒绝违章指挥和强令进行没有职业中毒危害防护措施的作业；

（七）参与用人单位职业卫生工作的民主管理，对职业病防治工作提出意见和建议。

用人单位应当保障劳动者行使前款所列权利。禁止因劳动者依法行使正当权利而降低其工资、福利等待遇或者解除、终止与其订立的劳动合同。

Regulations on Labor Protectionin Workplaces Where Toxic Substances Are Used (Revision on December 6, 2024;effective Januray 20, 2025)

Article 38

The workers areentitled to the following rights related to occupational health protections:

(1) to receiveoccupational health education and training;

(2) to obtainoccupational disease prevention and control services, including occupationalhealth examination, diagnosis, treatment and rehabilitation service;

(3) to beinformed of occupational poisoning hazard factors that generated or potentiallygenerated in workplaces, the consequences of such hazards, and the preventiveand protecitve measures against such hazards to be taken;

(4) to requestthe employing unit provide protective facilities against occupational poisoninghazards and relevant personal protective equipment that meet the requirementsfor the prevention and control of occupational diseases, and to improve theworking conditions;

(5) to raised criticism,report and accuse behaviors that violate occupational disease prevention lawsand regulations and endanger life and health;

(6) to refuse tofollow illegal instructions and to perform operations without preventionmeasures against occupational poisoning hazards;

(7) toparticipate in the democratic management of the employing unit’s occupationalhealth work, and to offer opinions and suggestions for the prevention andcontrol of occupational diseases.

The employingunits shall guarantee that the workers exercise the rights listed in thepreceding paragraph. It is prohibited to reduce the wages, benefits, etc. ofworkers, or rescind or terminate the labor contracts concluded with the workersbecause they exercise their legitimate rights according to law.
