超龄劳动者基本权益保障暂行规定 第十五条

用人单位应当为超龄劳动者参加工伤保险并缴纳工伤保险费，个人不缴纳工伤保险费。超龄劳动者因工作原因受到事故伤害或者患职业病的，按照规定进行工伤认定、劳动能力鉴定并享受相应的工伤保障待遇。超龄劳动者工伤保障办法另行制定。

Interim Provisions on the Protection of the BasicRights and Interests of Over-Age Workers, Article 15

The employer shall enroll over-age workers inwork-related injury insurance and pay the corresponding work-related injuryinsurance premiums. Over-age workers shall not be required to pay work-relatedinjury insurance premiums. Where an over-age worker sustains an injury as aresult of a work-related accident or develops an occupational disease in thecourse of work, determination of work-related injury and assessment of workingcapacity shall be conducted in accordance with the applicable provisions, andthe worker shall be entitled to the corresponding work-related injury insurancebenefits. Detailed measures for the work-related injury protection of over-ageworkers shall be formulated separately.
