中华人民共和国生态环境法典（2026年8月15日起施行）第四十九条

国家对严重污染环境、破坏生态等的技术、工艺、设备、材料、产品实行淘汰制度。

国务院发展改革部门会同有关部门确定严重污染环境、破坏生态等的技术、工艺、设备、材料、产品淘汰期限，并纳入国家综合性产业政策目录。

生产者、进口者、销售者、使用者应当在规定期限内停止生产、进口、销售、使用列入前款规定目录的设备、材料、产品。技术、工艺的采用者应当在规定期限内停止采用列入前款规定目录的技术、工艺。

被淘汰的设备、材料、产品，不得转让给他人使用。

The State shallimplement a phase-out system for technologies, processes, equipment, materialsand products that seriously pollute the environment, damage the ecology, orotherwise cause similar adverse impacts.

The departmentfor development and reform under the State Council shall, in conjunction withthe relevant departments, determine the time limits for phasing outtechnologies, processes, equipment, materials and products that seriouslypollute the environment, damage the ecology, or otherwise cause similar adverseimpacts, and shall incorporate them into the national catalogue ofcomprehensive industrial policies.

Producers,importers, sellers and users shall cease producing, importing, selling or usingthe equipment, materials and products included in the catalogue referred to inthe preceding paragraph within the prescribed time limit. Adopters oftechnologies and processes shall cease adopting the technologies and processesincluded in the catalogue referred to in the preceding paragraph within theprescribed time limit.

No phased-out equipment, materials orproducts shall be transferred to others for use.
