中华人民共和国生态环境法典（2026年8月15日起施行）第九十五条

国家根据建设项目对生态环境的影响程度，对建设项目的生态环境影响评价实行分类管理。

建设单位应当按照下列规定组织编制生态环境影响报告书、生态环境影响报告表或者填报生态环境影响登记表：

（一）可能造成重大生态环境影响的，应当编制生态环境影响报告书，对产生的生态环境影响进行全面评价；

（二）可能造成轻度生态环境影响的，应当编制生态环境影响报告表，对产生的生态环境影响进行分析或者专项评价；

（三）对生态环境影响很小，不需要编制生态环境影响报告书、生态环境影响报告表的，应当填报生态环境影响登记表。

建设项目的生态环境影响评价分类管理名录，由国务院生态环境主管部门制定并公布。

The State shallimplement a classified administration system for ecological and environmentalimpact assessments of construction projects according to the degree of theirimpacts on the ecology and environment.

A constructionentity shall organize the preparation of an ecological and environmental impactreport or an ecological and environmental impact report form, or complete anecological and environmental impact registration form, in accordance with thefollowing provisions:

1. where a construction project may cause significant impacts on the ecology and environment, an ecological and environmental impact report shall be prepared to provide a comprehensive assessment of such impacts;
2. where a construction project may cause minor impacts on the ecology and environment, an ecological and environmental impact report form shall be prepared to provide an analysis or a specific assessment of such impacts; and
3. where a construction project is likely to have only minimal impacts on the ecology and environment and it is unnecessary to prepare an ecological and environmental impact report or an ecological and environmental impact report form, an environmental impact registration form shall be completed.

The catalogue for the classifiedadministration of ecological and environmental impact assessments ofconstruction projects shall be formulated and published by the competentauthority of ecology and environment under the State Council.
