建设项目建设、运行过程中产生不符合经审批的生态环境影响报告书、生态环境影响报告表的情形的，建设单位应当组织生态环境影响的后评价，采取改进措施，并报原生态环境影响报告书、生态环境影响报告表审批部门和建设项目审批部门备案；原生态环境影响报告书、生态环境影响报告表审批部门也可以责成建设单位进行生态环境影响的后评价，采取改进措施。

Where, duringthe construction and operation of a construction project, circumstances arisethat are incompliant with the approved ecological and environmental impactreport or report form, the construction entity shall organize a post-ecological and environmental impact assessment, take improvement measures, andsubmit to the department that originally examined and approved the ecologicaland environmental impact report or report form and the department responsiblefor approving the construction project for filing.

The department that originally examined andapproved the ecological and environmental impact report or report form may alsoinstruct the construction entity to conduct a post-ecological and environmentalimpact assessment and take improvement measures.
