国家建立健全以排污许可制为核心的固定污染源监督管理制度，具体办法由国务院制定。

实行排污许可管理的企业事业单位和其他生产经营者应当按照规定取得排污许可证，未取得排污许可证的不得排放污染物。

Ecological and Environmental Code of The People's Republicof China (effective on August 15,2026), Article 174

The State shall establish and improve a supervisoryadministration system for stationary pollution sources with the pollutantdischarge permit system as its core. The specific measures shall be formulatedby the State Council.

Enterprises, public institutions and other producersand business operators subject to pollutant discharge permit administrationshall obtain a pollutant discharge permit in accordance with the relevantprovisions. No pollutants shall be discharged without obtaining a pollutantdischarge permit.
