中华人民共和国生态环境法典（2026年8月15日起施行）第一百七十六条

第一百七十六条 下列企业事业单位和其他生产经营者应当取得排污许可证：

（一）排放工业废气或者有毒有害大气污染物的企业事业单位和集中供热设施的燃煤热源生产运营单位；

（二）直接或者间接向水体排放工业废水、医疗污水的企业事业单位和其他生产经营者；

（三）城镇污水集中处理设施的运营单位；

（四）直接向海洋排放工业废水、医疗污水的海岸工程和海洋工程单位；

（五）产生工业固体废物的单位；

（六）排放工业噪声的企业事业单位和其他生产经营者；

（七）排放放射性废液或者产生放射性固体废物的伴生放射性矿开发利用单位；

（八）运行一类电磁辐射设施的企业事业单位和依法实行排污许可管理的运行二类电磁辐射设施的企业事业单位；

（九）其他依照法律、行政法规规定实行排污许可管理的企业事业单位和其他生产经营者。

Ecological and Environmental Code of The People's Republicof China (effective on August 15,2026), Article 176

The following enterprises, public institutions andother producers and business operators shall obtain a pollutant dischargepermit:

(1) enterprises and public institutions thatdischarge industrial waste gases or toxic and hazardous air pollutants, andoperators of coal-fired heat generation facilities for centralized heating;

(2) enterprises, public institutions and otherproducers and business operators that directly or indirectly dischargeindustrial wastewater or medical wastewater into water bodies;

(3) operators of urban centralized wastewatertreatment facilities;

(4) entities responsible for coastal engineeringprojects and offshore engineering projects that directly discharge industrialwastewater or medical wastewater into the sea;

(5) entities that generate industrial solid waste;

(6) enterprises, public institutions and otherproducers and business operators that emit industrial noise;

(7) entities engaged in the development andutilization of associated radioactive mineral resources that dischargeradioactive liquid waste or generate radioactive solid waste;

(8) enterprises and public institutions operatingCategory I electromagnetic radiation facilities, and enterprises and publicinstitutions operating Category II electromagnetic radiation facilities thatare subject to pollutant discharge permit administration in accordance with thelaw; and

(9) other enterprises, public institutions and otherproducers and business operators that are subject to pollutant discharge permitadministration in accordance with laws and administrative regulations.
