企业事业单位和其他生产经营者应当向其生产经营场所所在地设区的市级以上地方人民政府生态环境主管部门申请取得排污许可证。

海洋工程需要取得排污许可证的，应当向国务院生态环境主管部门或者国务院生态环境主管部门海域派出机构申请。

Ecological and Environmental Code of The People's Republicof China (effective on August 15,2026), Article 178

Enterprises, public institutions and otherproducers and business operators shall apply for a pollutant discharge permitto the competent authority of ecology and environment of the local people'sgovernment at or above the level of a city with districts where theirproduction and business premises are located.

Where an offshore engineering project is required toobtain a pollutant discharge permit, the application shall be submitted to thecompetent authority of ecology and environment under the State Council or toits dispatched agency for the marine area.
