第二百四十条 建设单位应当将扬尘污染防治费用列入工程造价，在施工合同中明确施工单位的扬尘污染防治责任。施工单位应当制定具体的施工扬尘污染防治实施方案。

从事房屋建筑、市政基础设施建设、河道整治以及建筑物拆除等施工单位，应当报负有扬尘污染防治监督管理职责的部门备案。

施工单位应当在施工工地设置硬质围挡，并采取覆盖、分段作业、择时施工、洒水抑尘、冲洗地面和车辆等有效防尘降尘措施。工程渣土等建筑垃圾、建筑土方应当及时清运；在场地内堆存的，应当采用密闭式防尘网遮盖。工程渣土等建筑垃圾应当进行资源化处理。

施工单位应当在施工工地公示扬尘污染防治措施、负责人、监督管理部门等信息。

暂时不能开工的建设用地，建设单位应当对裸露地面进行覆盖；超过三个月的，应当进行绿化、铺装或者遮盖。

Construction project owners shall include the costsof dust pollution prevention and control in the project cost and specify, inthe construction contract, the responsibilities of the contractor for dust pollutionprevention and control. Contractors shall develop specific implementation plansfor the prevention and control of construction dust pollution.

Contractors engaged in housing construction,municipal infrastructure construction, river regulation, demolition ofbuildings and other construction activities shall file a record with thedepartment responsible for the supervision and administration of dust pollutionprevention and control.

Contractors shall set up hard enclosures atconstruction sites and adopt effective dust prevention and suppression measuressuch as coverage, segmented operations, timed construction, water spraying tosuppress dust, and washing floors and vehicles. Construction waste such as constructiondebris and construction earthwork shall be removed in a timely manner; ifstored on site, a sealed dust-proof net shall be used for covering. Constructionwaste such as construction debris shall be disposed by resourceful treatment.

Contractors shall publicly display at constructionsites the information on dust pollution prevention and control measures,responsible person, and the competent supervisory authority.

For construction land where construction cannot bestarted temporarily, the construction project owner shall cover the exposed ground.Where commencement is delayed for more than three months, the exposed groundshall be landscaped, paved or covered.
