中华人民共和国生态环境法典（2026年8月15日起施行）第二百四十七条

国务院生态环境主管部门会同国务院卫生健康主管部门，根据大气污染物对公众健康、生态环境的危害和影响程度，制定公布有毒有害大气污染物名录并适时更新，实行风险管理。

排放前款规定名录中所列有毒有害大气污染物的企业事业单位，应当按照国家规定建设环境风险预警体系，对排污口和周边环境进行定期监测，评估环境风险，排查环境安全隐患，并采取有效措施防范环境风险。

Ecological and Environmental Code of The People's Republicof China (effective on August 15,2026), Article 247

The competent department of ecology and environmentunder the State Council shall, in conjunction with the competent department ofhealth under the State Council, formulate and publish a catalogue of toxic andhazardous air pollutants, update it in a timely manner based on the degree of harmand impact of air pollutants on public health and the ecology and environment,and implement risk management.

Enterprises, public institutions that emit toxic andhazardous air pollutants listed in the catalogue referred to in the precedingparagraph shall, in accordance with the relevant provisions of the State,establish an environmental risk early warning system, conduct periodicmonitoring of pollutant discharge outlets and the surrounding environment,assess environmental risks, investigate environmental safety hidden hazards,and take effective measures to be on guard against environmental risks.
