任何个人和未经批准的单位，不得向中华人民共和国管辖海域倾倒任何废弃物。

需要倾倒废弃物的，产生废弃物的单位应当向国务院生态环境主管部门海域派出机构提出书面申请，并出具废弃物特性和成分检验报告，取得倾倒许可证后，方可倾倒。

国家鼓励疏浚物等废弃物的综合利用，避免或者减少海洋倾倒。

禁止中华人民共和国境外的废弃物在中华人民共和国管辖海域倾倒。

Ecological and Environmental Code of The People's Republicof China (effective on August 15,2026), Article 371

No individual, or entity without approval, shalldump any wastes into the sea areas under the jurisdiction of the People'sRepublic of China.

Where the dumping of wastes is necessary, theentity generating the wastes shall submit a written application to the sea areadispatched agency of the competent department of ecology and environment underthe State Council, together with an inspection report on the characteristicsand composition of the wastes, and may dump such wastes only after obtaining adumping permit.

The State encourages the comprehensive utilizationof dredged materials and other wastes in order to avoid or reduce marinedumping.

No wastes originating outside the People's Republic ofChina shall be dumped into the sea areas under the jurisdiction of the People'sRepublic of China.
