土壤污染责任人负有实施土壤污染风险管控和修复的义务。土壤污染责任人无法认定的，土地使用权人应当实施土壤污染风险管控和修复。

The person responsible for the soil pollution isobligated to carry out soil pollution risk control and remediation.

Where the person responsible for the soil pollutioncannot be identified, the holder of the land use right shall carry out soilpollution risk control and remediation.
