国务院工业和信息化主管部门会同有关部门组织研究开发、推广减少工业固体废物产生量和降低工业固体废物危害性的生产工艺和设备，制定公布限期淘汰产生严重污染环境的工业固体废物的落后生产工艺、设备的名录。

生产者、进口者、销售者、使用者应当在国务院工业和信息化主管部门会同有关部门规定的期限内停止生产、进口、销售、使用列入前款规定名录中的设备。生产工艺的采用者应当在国务院工业和信息化主管部门会同有关部门规定的期限内停止采用列入前款规定名录中的工艺。

列入限期淘汰名录被淘汰的设备，不得转让给他人使用。

Ecological and Environmental Code of The People's Republicof China (effective on August 15,2026), Article 488

The competent department of industry andinformation technology under the State Council shall, jointly with the relevantdepartments, organize the research, development and promotion of productionprocesses and equipment that reduce the generation and harmfulness ofindustrial solid waste, and shall formulate and publish a catalogue of outdatedproduction processes and equipment, that generate industrial solid wastecausing serious environmental pollution and are to be phased out within aprescribed time limit.

Producers, importers, sellers and users shall ceaseproduction, importation, sale and use of equipment included in the cataloguereferred to in the preceding paragraph within the time limit prescribed by thecompetent department of industry and information technology under the StateCouncil jointly with the relevant departments. The adopter of productionprocesses shall cease adoption of the production processes included in thecatalogue referred to in the preceding paragraph within the prescribed timelimit.

Equipment included in the catalogue for phasing outwithin a prescribed time limit and that is phased out shall not be transferredto others for use.
