产生工业固体废物的单位应当根据经济、技术条件对工业固体废物加以利用；对暂时不利用或者不能利用的，应当按照国务院生态环境等有关部门的规定建设贮存设施、场所，安全分类存放，或者采取无害化处置措施。贮存工业固体废物应当采取符合国家生态环境保护标准的防护措施。

建设工业固体废物贮存、处置的设施、场所，应当符合国家生态环境保护标准。

Ecological and Environmental Code of The People's Republicof China (effective on August 15,2026), Article 494

An entity that generates industrial solid wasteshall, where economically and technically feasible, utilize such industrialsolid waste. Where such waste is not utilized temporarily or cannot beutilized, the entity shall, in accordance with the provisions of the relevantdepartments under the State Council including the competent department ofecology and environment, construct storage facilities and sites, store thewaste by classification and in a safe manner, or adopt measures for harmlessdisposal. Protective measures that comply with the national ecological andenvironmental protection standards shall be taken for storage of industrialsolid waste.

The construction of facilities and sites for thestorage or disposal of industrial solid waste shall comply with the nationalecological and environmental protection standards.
