产生工业固体废物的单位终止的，应当在终止前对工业固体废物的贮存、处置的设施、场所采取污染防治措施，并对未处置的工业固体废物作出妥善处置，防止污染环境。

产生工业固体废物的单位发生变更的，变更后的单位应当按照国家有关生态环境保护的规定对未处置的工业固体废物及其贮存、处置的设施、场所进行安全处置或者采取有效措施保证该设施、场所安全运行。变更前当事人对工业固体废物及其贮存、处置的设施、场所的污染防治责任另有约定的，从其约定。但是，不得免除当事人的污染防治义务。

Where an entity that generates industrial solidwaste terminates, it shall, before termination, take pollution prevention andcontrol measures with respect to the facilities and sites for the storage anddisposal of industrial solid waste, and ensure the proper disposal of any untreatedindustrial solid waste so as to prevent environmental pollution.

Where an entity that generates industrial solid wasteundergoes change, the entity after the change shall, in accordance with therelevant State provisions on ecological and environmental protection, safelydispose of any untreated industrial solid waste and the facilities and sitesused for its storage or disposal, or take effective measures to ensure the safeoperation of such facilities and sites. Where the parties have otherwiseagreed, before the change, on the responsibilities for pollution prevention andcontrol relating to industrial solid waste and the facilities and sites for itsstorage and disposal, such agreement shall prevail. However, such agreementshall not exempt the parties from their obligations for pollution preventionand control.
