产生危险废物的单位，应当按照国家规定制定危险废物管理计划；建立危险废物管理台账，如实记录有关信息，并通过国家危险废物信息管理系统向所在地生态环境主管部门申报危险废物的种类、产生量、流向、贮存、利用、处置等有关资料。

前款所称危险废物管理计划应当包括减少危险废物产生量和降低危险废物危害性的措施以及危险废物贮存、利用、处置措施。危险废物管理计划应当报产生危险废物的单位所在地生态环境主管部门备案。

产生危险废物的单位已经取得排污许可证的，执行排污许可管理制度的规定。

Ecological and Environmental Code of The People's Republicof China (effective on August 15,2026), Article 532

An entity that generates hazardous waste shall, inaccordance with State regulations, formulate a hazardous waste management plan;establish hazardous waste management legers, truthfully record the relevantinformation, and, through the national hazardous waste information managementsystem, declare to the competent department of ecology and environment in theplace where it is located, the information on types, quantities, flow, storage,utilization and disposal of the hazardous waste.

The hazardous waste management plan referred to inthe preceding paragraph shall include measures to reduce the generation andharmfulness of hazardous waste, as well as measures for the storage,utilization and disposal of hazardous waste. The hazardous waste managementplan shall be filed with the competent department of ecology and environment inthe place where the hazardous waste is generated for record.

Where an entity generating hazardous waste hasobtained a pollutant discharge permit, the provisions governing the pollutantdischarge permit system shall apply.
