中华人民共和国生态环境法典（2026年8月15日起施行）第七百六十九条

依照法律、行政法规的规定申请临时用地的，应当尽量不占或者少占耕地、避让永久基本农田，不得修建永久性建筑物。临时用地确需占用耕地的，应当按照规定恢复种植条件。

Where an application is made for temporary land usein accordance with laws and administrative regulations, cultivated land shall,to the greatest extent possible, be avoided or minimized, and permanent basicfarmland shall be avoided. No permanent buildings or structures shall beconstructed.

Where the temporary use ofcultivated land is necessary indeed, the land shall be restored to conditions ofcultivation in accordance with the relevant provisions.
