国家对水域、滩涂利用进行统一规划，确定可以用于养殖业的水域和滩涂，建立养殖水域、滩涂保护制度；单位和个人使用国家所有的水域、滩涂从事养殖生产的，应当依照《中华人民共和国渔业法》的规定取得养殖证。

从事养殖生产应当保护水域、滩涂生态环境，科学确定养殖密度和养殖规模，合理投饵、投饲、投药，养殖排放尾水应当符合有关污染物排放标准，不得破坏水域、滩涂的生态环境。

Ecological and Environmental Code of The People's Republic ofChina (effective on August 15, 2026), Article 798

The State shall make unified plans for the use ofwaters and tidal flats, determine waters and tidal flats suitable foraquaculture, and establish a protection system for aquaculture waters and tidalflats. Any entity or individual using State-owned waters or tidal flats foraquaculture production shall obtain an aquaculture license in accordance withthe provisions of the Fisheries Law of the People's Republic of China.

Persons engaged inaquaculture production shall protect the ecological environment of waters andtidal flats, scientifically determine aquaculture density and scale, and reasonablyfeed with bait or aquafeeds and use of drugs. Tailwater discharged fromaquaculture operations shall comply with the applicable pollutant dischargestandards and shall not damage the ecological environment of waters and tidalflats.
