中华人民共和国生态环境法典（2026年8月15日起施行）第八百零六条

新建、改建、扩建工程建设项目，应当采取有效措施，保护国家和地方重点保护的野生动植物及其生存环境，保护海洋水产资源，避免或者减轻对海洋生物的影响。

使用海域的单位和个人应当依照《中华人民共和国海域使用管理法》的规定，保护和科学合理使用海域，不得擅自改变经批准的海域用途。海域使用权终止后，应当及时拆除可能造成海洋环境污染、生态破坏或者影响其他用海项目的用海设施和构筑物。

Newly constructed, expanded or reconstructedconstruction projects shall adopt effective measures to protect wildlife underState and local key protection and their habitats, protect marine fisheryresources, and avoid or mitigate adverse impacts on marine life.

Entities and individualsusing sea areas shall, in accordance with the provisions of the Sea Area UseAdministration Law of the People's Republic of China, protect and makescientific and rational use of sea areas, and shall not alter the approved useof a sea area without authorization. Upon the termination of the right to use asea area, facilities and structures associated with the use of the sea areathat may cause marine environmental pollution, ecological damage, or interferewith other sea use projects shall be promptly dismantled.
