生产、进口、销售依法列入强制回收名录的产品和包装物的企业，应当按照国家规定对该产品和包装物进行回收。对其中可以利用的，由企业负责利用；对因不具备技术经济条件而不适合利用的，由企业负责无害化处置。

对前款规定的废弃产品或者包装物，生产者委托销售者或者其他组织进行回收，或者委托废弃物利用、处置企业进行利用、处置的，受托方应当依照有关法律、行政法规的规定和合同的约定负责回收或者利用、处置。

强制回收的产品和包装物的名录及管理办法，由国务院发展改革部门会同有关部门制定。

Enterprises that produce, import or sell productsand package materials included in the mandatory recycling catalogue inaccordance with the law shall recycle such products and package materials inaccordance with State regulations. For those that can be utilized, theenterprises shall be responsible for their utilization. For those that are notsuitable for utilization due to lack of technical or economic conditions, theenterprises shall be responsible for their environmentally sound disposal.

Where a producer entrusts a seller or anotherorganization with the recycling of the waste products or package materials providedfor in the preceding paragraph, or entrusts an enterprise specialized in wasteutilization or disposal to use or dispose of, the entrusted party shall beresponsible for the recycling, utilization or disposal in accordance withrelevant provisions of laws, administrative regulations and the contractual agreements.

The catalogue andmanagement measures of products and package materials subject to mandatory recyclingshall be formulated by the development and reform department under the StateCouncil jointly with relevant departments.
