中华人民共和国生态环境法典（2026年8月15日起施行）第九百八十七条

企业利用废弃物和从废弃物中回收原料生产产品，应当采用先进适用的技术、工艺和设备，提高回收利用率和加工利用水平。

对废弃电器电子产品、报废机动车船和飞机、废轮胎、废铅蓄电池、废旧动力电池等特定产品进行拆解、处置或者再利用，应当符合本法和《中华人民共和国循环经济促进法》等有关法律法规的规定，禁止使用国家明令淘汰或者不符合生态环境保护要求的落后拆解加工技术、工艺和设备。

Enterprises that utilize waste or recover rawmaterials from waste to manufacture products shall adopt advanced andapplicable technologies, processes, and equipment to improve the recycling rateas well as the level of processing and utilization.

The dismantling, disposal,or reuse of specific products such as waste electrical and electronic products,obsolete motor vehicles, vessels and aircraft, waste tires, waste lead-acidbatteries, and waste power batteries, shall comply with the provisions of this Code,the Circular Economy Promotion Law of the People’s Republic of China, and otherrelevant laws and regulations. The use of obsolete dismantling and processingtechnologies, processes, or equipment that are explicitly eliminated by theState or that fails to meet the requirements of ecological and environmentalprotection shall be prohibited.
