中华人民共和国生态环境法典（2026年8月15日起施行）第一千零三十七条

温室气体重点排放单位应当采取有效措施控制温室气体排放，按照国家规定和国务院生态环境主管部门制定的技术规范，开展温室气体统计核算，编制温室气体年度排放报告，报省级人民政府生态环境主管部门核查后，按照规定的期限足额清缴碳排放配额。温室气体重点排放单位应当对排放统计核算数据、年度排放报告的真实性、准确性和完整性负责。

温室气体重点排放单位名录由省级人民政府生态环境主管部门会同有关部门，依据国务院生态环境主管部门确定的条件制定。

Key emitting entities of greenhouse gases shalltake effective measures to control greenhouse gas emissions, conduct greenhousegas statistical accounting, and prepare annual greenhouse gas emission reportsin accordance with State regulations and the technical specificationsformulated by the competent department of ecology and environment under theState Council. After such reports have been verified by the competent departmentof ecology and environment of the provincial-level people’s government, theyshall surrender their carbon emission allowances in full within the prescribedtime limit. Key emitting entities of greenhouse gases shall be responsible forthe authenticity, accuracy, and completeness of their emission statisticalaccounting data and annual emission reports.

The list of key emittingentities of greenhouse gases shall be formulated by the competent department ofecology and environment of the provincial-level people’s government inconjunction with relevant departments, based on the criteria determined by thecompetent department of ecology and environment under the State Council.
