劳务派遣暂行规定 第十九条

劳务派遣单位在用工单位所在地设立分支机构的，由分支机构为被派遣劳动者办理参保手续，缴纳社会保险费。

劳务派遣单位未在用工单位所在地设立分支机构的，由用工单位代劳务派遣单位为被派遣劳动者办理参保手续，缴纳社会保险费。

Interim Provisions on Labor Dispatch, Article 19

In the event that a labor-dispatching unit dispatching a worker to an employer has set up a branch at the place where the employer is located, the branch shall complete the formalities for obtaining social security insurance coverage and pay the social security insurance premium for the dispatched worker.

In the event that a labor-dispatching unit dispatching a worker to an employer does not set up a branch at the place where the employer is located, the employer shall complete the formalities for obtaining social security insurance coverage and pay the social security insurance premium for the dispatched worker on behalf of the labor-dispatching unit.
