在中国境内的企业、事业单位、机关、社会组织(以下统称用人单位)中以工资收入为主要生活来源的劳动者,不分民族、种族、性别、职业、宗教信仰、教育程度,都有依法参加和组织工会的权利。任何组织和个人不得阻挠和限制。

Trade Union Law of the People's Republic of China, Article 3 (effective since January 1, 2022)

All workers in enterprises, institutions, government agencies, and social organizations (hereinafter collectively referred to as the employing units) within the territory of China who rely on wages or salaries as their main source of income, irrespective of their nationality, race, sex, occupation, religious belief or educational background have the right to organize or join trade unions according to law. No organizations or individuals shall obstruct or restrict them.
